Use of easyDICTATE service through smartphone app is governed by the Terms of Use mentioned here. Use of the said service constitutes your willingness to follow these rules and also to be bound by them. easyDICTATE (hereafter referred to as “the Company”), located at 582 Market St Suit 807 San Francisco, CA 94104, provides the Service.
This is a legal agreement (“Agreement”) between the client and the Company, so the client is required to read this Agreement and all information referenced herewith carefully before registering for the said Service. By completing your registration, you will become a registered user of the Service (a "Registered User") and you agree to be bound by these Terms of Use (the "Terms") for as long as you continue to be a Registered User. IF YOU ARE NOT AGREEABLE TO THE TERMS, PLEASE REFRAIN FROM REGISTERING FOR THE SERVICE.
The Terms are subject to change by the Company at any time, effective upon posting updated Terms of Use on the Website; any use or access of the Service after such notice will constitute acceptance by you of such changes.
1. Use of Smartphone App
- easyDICTATE provides free App that can be downloaded on your iOS or Android smartphone. The App lets clients record on their smartphone and upload voice recording to their easyDICTATE account directly. If you are using the App, you understand that:
- easyDICTATE is not guaranteeing quality of the recording on your smartphone. Recording quality can vary based on your software version and your smartphone software. It can also vary based on the speed of your internet connection.
- You (client) should test the recording quality first before using the App.
- You (client) should also follow suggestions for using App that may show up when you start using the App.
- If the audio quality is poor, or when the recording subject is considered objectionable, easyDICTATE can at their will reject any transcription project. easyDICTATE is not bound to assign any reason for rejecting your project.
2. Transcription Accuracy:
easyDICTATE guarantees a 98% accuracy rate for only “good” audio with up to two persons in the recording. Should Client feel that any work performed by Vendor does not meet this accuracy rate, client should contact us NO LATER than two (2) weeks of receipt of transcript(s). Client understands and accepts that transcript can never be "perfect." At times, judgment calls have to be made, and Client understands this. If the Client is of the opinion that the accuracy rate is below 98%, and the audio is deemed “good” quality, easyDICTATE will correct the error(s) and return the transcript as soon as possible. Corrections will not be made on orders that have audio files deemed or uploaded to us as poor quality audio.
Even though it is our endeavor to strive for 98% or better accuracy for audio considered as "good", Client must agree to release easyDICTATE, its officers, and employees, of any damages that might occur from the publication, quotation, distribution or public use of a quotation from the transcript that may contain a typographical or factual error or even those without error. Client must take responsibility for confirming a transcript’s accuracy prior to information from a transcript being printed or published and will not imply or list easyDICTATE or any of its employees as defendant in any litigation.
3. Indemnification
Although easyDICTATE will take necessary steps to complete the transcription process on time and with accuracy, delivery date or quality of the transcripts cannot be guaranteed absolutely. easyDICTATE agrees redo the transcript if it is sub-standard and will attempt to deliver it on time. However, easyDICTATE cannot be held responsible for any losses due to a delay in delivery or inaccuracy that may occur. By signing this contract, the client indemnifies easyDICTATE from any losses that may be incurred due to project delays or in accuracy of the transcripts.
4. Agreement
"Client" understands and agrees that agreeing to the Terms and Conditions, or Terms of Service (TOS), binds Client to the Terms of Service (TOS) mentioned here. easyDICTATE holds the right to change or modify this Terms of Service (TOS) agreement on occasion. Any modifications or changes made will appear on the http://easydictate.net website.
5. Cancellation Of Service
The Service may be discontinued or cancelled by simply not submitting any additional files to Company for transcription at any time.
easyDICTATE reserves the right to terminate your account at any time effective upon providing you electronic notice via text message or the email address on file. If for any reason easyDICTATE terminates your account, you cease to have the right to use easyDICTATE immediately. The Company currently does not plan to terminate any accounts, other than for non-use, for violating this agreement.
6. File Delivery
Completed transcripts are available on the Transcripts page when you log into your account. Although completed transcripts are also emailed to you, easyDICTATE is not responsible for any non-receipt of a file by email for any reason. If ever you don't receive a file by email, it is a good idea to make sure (i) your email address has been entered correctly in your profile, (ii) the transcripts are not in your spam folder, and (iii) that your mail service provider is not blocking mail from easyDICTATE.
7. Duplicate Files
easyDICTATE infrastructure and computer code has been developed so that easyDICTATE cannot assign an audio file to be transcribed more than one time. The same file being transcribed several times will occur only if client submits a file multiple times, whether unintentionally or intentionally. A file is a duplicate if the same audio has been received more than one time and has been automatically assigned a different file number.
8. Copyright
All the content present in the Website, including text, logos, images, audio clips, button icons, software, and digital downloads, are the property of easyDICTATE. The compilation of all content on this site is the exclusive property of easyDICTATE and is protected by international copyright laws. All software used on this site is the property of easyDICTATE or its software licensors.
9. Proprietary Rights
The Company owns and retains proprietary rights in the Service. The Service includes copyrighted material, trademarks, and other proprietary information of the Company, its licensors and licensees.
